The claim was struck out for non-pursuit. The tribunal gave the claimant until 8 November 2024 to make representations or request a hearing as to why the claim should not be struck out. Facts

Mr Sargeant brought a claim against Clapton Park Management Organisation Limited and Mr Jagdish Kumar. On 16 October 2024, the tribunal issued an order giving the claimant until 8 November 2024 to make representations or request a hearing as to why the claim should not be struck out for non-pursuit. The claimant failed to respond to this order or make sufficient representations.

Decision

Employment Judge Misra KC struck out the claim on 7 January 2025 due to the claimant's failure to actively pursue it. The claimant did not respond to the tribunal's unless order dated 16 October 2024, and the scheduled hearing for July 2025 was cancelled.

Practical note

Failure to comply with tribunal orders and actively pursue a claim will result in strike-out, regardless of the underlying merits of the case.
