Claimant v Sainsbury's Supermarkets Ltd
Outcome
Individual claims
The tribunal found that the claim was presented outside the applicable time limit and that it was reasonably practicable for the claimant to have presented the claim within the time limit. The claim was therefore dismissed for lack of jurisdiction as the tribunal had no power to hear an out-of-time claim where it was reasonably practicable to present in time.
Facts
Mrs Dhimer brought an unfair dismissal claim against Sainsbury's Supermarkets Ltd. The case came before Employment Judge Taft at Cambridge Employment Tribunal by video on 18 December 2025 for a preliminary hearing to determine whether the claim was presented in time. The claimant was represented by her son, Mr Dhimer, as a lay representative. The respondent was represented by counsel, Mr Adamou.
Decision
Employment Judge Taft found that the unfair dismissal claim was not presented within the applicable time limit and that it was reasonably practicable for the claimant to have done so. The claim was therefore dismissed on jurisdictional grounds as the tribunal had no power to hear it.
Practical note
Claimants must strictly comply with the time limit for presenting unfair dismissal claims, and tribunals cannot extend time where it was reasonably practicable to present the claim within the statutory period.
