Outcome

Claimant succeeds£4,652

Individual claims

Holiday Paysucceeded

The tribunal found the claimant had not taken any paid holiday in the last holiday year and had not been reminded or encouraged to take it. She was entitled to 5.6 weeks annual leave per year. The tribunal awarded accrued holiday for the period 26 May 2023 to 31 March 2024 (4.76 weeks) and for 1 April 2024 to 1 December 2024 (3.73 weeks), totalling £4,310.29.

Unlawful Deduction from Wagesfailed

The claimant's claim relating to late payment of salary and expenses was not well-founded. The tribunal found insufficient evidence to support an unlawful deduction of wages claim on these grounds.

Breach of Contractsucceeded

The tribunal found the respondent had agreed to reimburse the claimant for expenses of £342.10 and failed to do so. This constituted a breach of contract and the claimant was awarded this sum.

Facts

Ms Ike was employed by New Beginnings 16plus Limited from 26 May 2023 until 1 December 2024, with a net monthly salary of £2,200. During her employment she took no paid holiday, and was not reminded or encouraged to do so by her employer. She claimed for unpaid accrued holiday, late payment of salary and expenses, and unreimbursed expenses that the respondent had agreed to pay. The respondent did not appear at the hearing.

Decision

The tribunal made a default judgment under Rule 22. The holiday pay claim succeeded in full, with the tribunal awarding £4,310.29 for untaken holiday over two holiday years. The breach of contract claim for agreed expenses of £342.10 also succeeded. However, the unlawful deduction of wages claim regarding late salary payments failed. Total award: £4,652.39.

Practical note

Employers who fail to remind employees to take holiday may be liable for multiple years' accrued holiday pay, and default judgments will be entered where respondents fail to participate in proceedings.
