Direct Discrimination(race)failed

After a 10-day full merits hearing, the tribunal unanimously dismissed the claimant's claim of direct race discrimination. The tribunal did not find that the claimant had been treated less favourably because of race, and/or that the claimant failed to prove facts from which the tribunal could conclude discrimination had occurred.

The tribunal found that the allegations of harassment related to race were not made out. The claimant did not establish that unwanted conduct related to race occurred or that such conduct had the purpose or effect of violating her dignity or creating an intimidating, hostile, degrading, humiliating or offensive environment.

The victimisation claim failed. The tribunal concluded that the claimant had not done a protected act, or if she had, that the respondents did not subject her to detriment because she had done a protected act.

Indirect Discrimination(disability)failed

The tribunal dismissed the indirect disability discrimination claim, finding either that no provision, criterion or practice (PCP) was applied that put disabled persons at a particular disadvantage, or that the claimant failed to establish she suffered such disadvantage, or that any PCP was justified as a proportionate means of achieving a legitimate aim.

Failure to Make Reasonable Adjustments(disability)failed

The tribunal found that the respondents did not fail to make reasonable adjustments. Either the claimant did not establish that she was placed at a substantial disadvantage by a provision, criterion or practice, or the tribunal concluded that the respondents had made, or were not required to make, the adjustments sought.

Facts

Ms Hassan brought claims of direct race discrimination, harassment related to race, victimisation, indirect disability discrimination and failure to make reasonable adjustments against Coventry University and two related entities. The claimant represented herself at a 10-day full merits hearing, assisted by her sister. The respondents were represented by counsel. The tribunal heard evidence on the various allegations.

Decision

The tribunal unanimously dismissed all of Ms Hassan's claims. The tribunal concluded that she had not established direct race discrimination, harassment related to race, or victimisation. The tribunal also found that the claims of indirect disability discrimination and failure to make reasonable adjustments were not made out.

Practical note

An unrepresented claimant bringing multiple discrimination claims against an educational institution failed to establish any of her claims after a 10-day contested hearing before a full tribunal panel.
