Facts

Miss Mumford brought claims against her former employer Qube Qualifications and Development Limited (which had entered creditors voluntary liquidation) and the Secretary of State for Business and Trade for notice pay, holiday pay, redundancy pay and unpaid wages. The Tribunal made an Order on 20 June 2025 which the claimant failed to comply with. The Tribunal gave the claimant a final opportunity to make representations or request a hearing by letter dated 5 September 2025.

Decision

The Tribunal struck out all of the claimant's claims on the basis that she had failed to actively pursue them, specifically by failing to comply with the Tribunal's earlier Order and failing to respond to the unless order warning letter. No hearing was held as the claimant made no representations.

Practical note

Claimants must comply with tribunal orders and respond to unless order warnings, or their claims will be struck out for non-pursuit even where the respondent is insolvent and claims are brought against the Secretary of State.
