Facts

Miss Gregory brought claims for notice pay and arrears of pay against her former employer Qube Qualifications and Development Limited, which had entered creditors voluntary liquidation, and the Secretary of State for Business and Trade. The Tribunal issued an order on 20 June 2025 which the claimant failed to comply with. On 5 September 2025, the Tribunal gave the claimant an opportunity to make representations or request a hearing as to why her claims should not be struck out for non-pursuit. The claimant did not respond.

Decision

Employment Judge Shastri-Hurst struck out the claims for notice pay and arrears of pay on the basis that the claimant had failed to comply with the Tribunal's order, had not actively pursued the claims, and had not made any representations or requested a hearing when given the opportunity to do so.

Practical note

Claimants must comply with tribunal orders and actively pursue their claims, or face strike-out for non-pursuit even where the respondent is insolvent and the Secretary of State is joined as second respondent.
