Claimant v Lidl Great Britain Limited
Outcome
Individual claims
Claim struck out for non-pursuit. The claimant failed to comply with a Tribunal Order dated 24 April 2025 and failed to actively pursue the claim. Despite being given an opportunity to make representations or request a hearing by letter dated 8 August 2025, the claimant failed to respond or make any sufficient representations.
Facts
Mr Rymell brought a claim against his former employer Lidl Great Britain Ltd. The Tribunal issued an Order on 24 April 2025 which the claimant failed to comply with. On 8 August 2025, the Tribunal wrote to the claimant giving him an opportunity to make representations or request a hearing as to why the claim should not be struck out for non-compliance and failure to actively pursue the claim. The claimant failed to respond.
Decision
The Tribunal struck out the claim for non-pursuit under its case management powers. The claimant had failed to comply with a previous Order, failed to actively pursue the claim, and failed to respond to the unless order or request a hearing. A scheduled full merits hearing for 30-31 October 2025 was cancelled.
Practical note
Claimants must comply with Tribunal orders and actively pursue their claims; failure to respond to an unless order will result in strike out even where a full hearing is scheduled.
