Individual claims

Unfair Dismissalfailed

The tribunal found the complaint of unfair dismissal was not well-founded. The claim was dismissed after a four-day hearing at which the claimant did not attend.

Direct Discrimination(race)failed

The claim was presented outside the applicable time limit and the tribunal found it was not just and equitable to extend time. Additionally, even if time had been extended, the tribunal found the complaint was not well-founded on its merits.

Direct Discrimination(age)failed

The claim was presented outside the applicable time limit and the tribunal found it was not just and equitable to extend time. Additionally, even if time had been extended, the tribunal found the complaint was not well-founded on its merits.

Facts

Miss Simpson brought claims of unfair dismissal and direct race and age discrimination against her former employer Transport for London. A four-day remote video hearing was listed for July 2025. Miss Simpson did not attend the hearing and was unrepresented throughout.

Decision

The tribunal dismissed all three claims. The unfair dismissal claim failed on its merits. The race and age discrimination claims were presented out of time and the tribunal declined to extend time on just and equitable grounds. In the alternative, the tribunal also found both discrimination claims failed on their merits.

Practical note

Claimants must attend their hearings and present claims within statutory time limits; non-attendance and late filing both led to complete dismissal of all claims.
