Outcome
Individual claims
Claim struck out for non-compliance with Tribunal order dated 4 September 2025 and for not being actively pursued. Claimant failed to make representations or request a hearing following notice dated 7 March 2025.
Facts
Mr Atupem brought a claim against Mitie Limited. The tribunal made an order on 4 September 2025 which the claimant failed to comply with. On 7 March 2025, the tribunal wrote to the claimant giving him an opportunity to make representations or request a hearing as to why the claim should not be struck out for non-compliance and for not being actively pursued. The claimant failed to respond.
Decision
The tribunal struck out the claim on the papers without a hearing. The claimant had failed to comply with a previous tribunal order and had failed to make any representations or request a hearing when given the opportunity to explain why the claim should not be struck out.
Practical note
Claimants must comply with tribunal orders and respond to strike-out warning letters, or risk having their claims dismissed without a hearing.
