Outcome

Claimant fails

Individual claims

Otherstruck out

Claims struck out for non-pursuit. Claimants breached tribunal orders dated 7 June 2024, failed to actively pursue the claims, and failed to make representations or request a hearing regarding the proposed strike-out.

Facts

Two claimants, Ms T Marques and Ms M Seidi, brought claims against East 45 Limited. The tribunal issued orders on 7 June 2024 which the claimants failed to comply with. On 3 December 2024, the tribunal wrote to the claimants giving them an opportunity to make representations or request a hearing as to why their claims should not be struck out for breach of orders and non-pursuit. The claimants failed to respond.

Decision

Employment Judge Batten struck out both claims on 9 January 2025 due to the claimants' breach of tribunal orders, failure to actively pursue their claims, and failure to make any representations in response to the tribunal's unless letter. The scheduled 9-day hearing for July 2025 was cancelled.

Practical note

Unrepresented claimants must comply with tribunal orders and actively pursue their claims or risk strike-out, even when given a final opportunity to respond.
