Facts
Mr Sidhu brought claims of unfair dismissal, wrongful dismissal and failure to pay outstanding holiday pay against Amazon UK Services Ltd. The claimant was unrepresented and appeared in person. The respondent was represented by Mr Sangha. A preliminary hearing was held to determine whether the claims were presented in time.
Decision
The tribunal found that all three claims were not presented within the applicable time limits. Critically, the tribunal concluded it was reasonably practicable for the claimant to have presented the claims in time. As a result, the tribunal had no jurisdiction to hear the claims and dismissed them all.
Practical note
Self-represented claimants must ensure claims are presented within statutory time limits as tribunals have no jurisdiction to hear out-of-time claims where it was reasonably practicable to comply.
